Full bench declares Interim Govt legal

The Appellate Division of the Supreme Court (SC) on Thursday declared the formation and subsequent oath-taking by the present Interim Government legal.
With the order the Appellate Division dismissed a leave to appeal against the High Court order that had upheld the formation and oath of the interim government, unanimously.
“Dismissed with observation,” said the Appellate Division full bench, headed by Chief Justice Syed Refaat Ahmed.
Advocate Muhammad Mohsen Rashid filed the plea, challenging the legality of the president’s reference and the Supreme Court’s advisory opinion on the formation of the interim government.
Advocate Rashid moved his plea himself, while senior jurist Dr Sharif Bhuiyan argued for intervener Feroz Ahmed. Senior advocates Ruhul Quddus Kazal and Mohammad Shishir Manir participated in the hearing as interveners.
Attorney General Md Asaduzzaman and Additional Attorney General Aneek Rushd Haque stood for the state.
After the fall of the Awami League government on August 5, 2024, the President sought the opinion of the Supreme Court under Article 106 of the Constitution regarding the formation of an interim government to run the country.
Following the opinion of the Appellate Division of the Supreme Court, an interim government was formed under the leadership of Professor Muhammad Yunus. The members of the Advisory Council were sworn in.
Advocate Muhammad Mohsen Rashid filed a writ petition in the High Court challenging the reference sent to the Supreme Court and the process of obtaining its opinion regarding the formation and oath of the interim government.
After holding a hearing on the writ, a High Court bench comprising Justice Fatema Najib and Justice Shikdar Mahmudur Razi summarily rejected the petition.
Lawyer Mohammad Mohsin Rashid later filed a leave-to-appeal petition against the High Court order.
