Sarowar Alam, winner of Chattogram-2 constituency, can take oath as an MP: HC

The High Court has ruled that Sarowar Alamgir, the BNP candidate who won the Chattogram-2 constituency in the 13th National Parliament election, can take oath as an MP. 

The High Court gave this verdict by declaring his candidacy valid.

The High Court bench comprising Justice Fahmida Quader and Justice Md. Asif Hasan declared the rule issued in this regard as valid and announced the verdict on Thursday.

After the verdict, the writ petitioner's lawyer Barrister AM Mahbub Uddin Khokon told reporters, “Now the Election Commission will carry out its next activities. There is no longer any obstacle to taking the gazette and oath.”

Earlier, after hearing on the rule on July 2, the court fixed the date for the verdict today. Senior lawyer Ahsanul Karim and Barrister AM Mahbub Uddin Khokon MP heard the case on behalf of the writ petitioner in the court. On the other hand, senior lawyer Mohammad Shishir Monir and lawyer Azim Uddin Patwary were on behalf of Jamaat candidate Md. Nurul Amin.

After Sarowar Alamgir's candidacy was declared valid by the returning officer, Jamaat candidate Md. Nurul Amin appealed against him, alleging loan default. 

After the hearing, the Election Commission cancelled Sarowar Alamgir's candidacy on January 18. 

Sarowar Alamgir filed a writ petition in the High Court against this. On January 27, the High Court suspended the order of the Election Commission. At the same time, a rule was issued allowing him to participate in the election. 

Later, Nurul Amin filed a leave to appeal against the High Court order in the Appellate Division. 

On February 3, the Appellate Division granted leave to appeal. As a result, even though Sarowar Alamgir got the opportunity to participate in the election, the Appellate Division ordered that the election results be suspended until the appeal is disposed of. That is, even if he is able to participate in the election, his results cannot be published.

Later, Sarowar Alamgir won the February 12 election unofficially. However, his results were not published due to the court's instructions.

Then, after hearing the appeal filed by Jamaat candidate Nurul Amin, the Appellate Division issued an order on June 16. 

The order directed the High Court to dispose of the appeal quickly, if possible within two weeks, after disposing of the rule. The appeal was disposed of in the High Court with the announcement of the verdict today.
